Re: Denver Basin Non-tributary Ground Water Rights
Dear Mr. Duthie:
I am writing to determine your interest in the decreed ground water rights in the Dawson, Denver, Arapahoe and Laramie-Fox Hills aquifers which are adjacent to your filing in the Division 2 Water Court, Case No. 04CW22. It is the balance of water rights not obligated underneath Bent Tree Subdivision. These water lights would provide significant future water supplies for the District. I have included a location map of the subdivision for your reference. Right-of-way for pipelines and wells has been provided for in the platting of Bent Tree.
The unencumbered water rights for the Denver, Arapahoe and Laramie-Fox Hills were decreed in Water Division 2 Water Court in Case No. 82CW295. The Dawson Aquifer was decreed non-tributary in Water Division 1 Water Court Case No, W-8269-76. A small part of the Dawson and Denver aquifers are committed to the Great Divide Water Company for plans for augmentation.
According to my calculations, the following amounts of non-tributary ground water are available for direct use or augmentation:

@ 101 ac-ft of this aquifer is available for sale which is the balance of the appropriation of 121 ac-ft; the balance has been committed to the Great Divide Water Company.
* Colorado Division of Water Resources has approved the increase of the 1982 decreed amount to 494 ac-ft on the basis of the Denver well drilled on Bent Tree; the balance of the water has been committed to Great Divide Water Company for various plans of augmentation.
**Subject to approval by the Colorado Division of Water Resources and the Water Court. The 1982 decreed amount is subject to adjustment when a well is drilled and logged. The estimate is based on Arapahoe aquifer data in the region.
